APD Declares 'No-Refusal' DWI Action Tuesday for Mardi Gras

As people prepare to celebrate Mardi Gras, the Austin Police Department has declared a "no-refusal" for Fat Tuesday.

During no-refusal actions, officers can obtain blood search warrants on suspects who refuse to willingly provide a breath sample or cooperate with a blood test. Another Mardi Gras no-refusal action was in place over the weekend, and APD said 18 people were arrested under the initiative.

1. You're More Likely to Get Caught Tonight:

The Austin Police Department is enforcing a "No Refusal policy" beginning tonight at 9 and ending Thursday at 5 a.m.

That means police will conduct blood search warrants on drivers who are pulled over on suspicion of drunk driving and refuse to voluntarily submit to a breathalyzer or blood test.

2. It'll Cost You:

Police say anyone found with a blood alcohol content of .08 or higher will be charged with a Class B misdemeanor and could face 3 days to 6 months in jail, a one year suspension of their driver’s license and a fine of up to $2,000 for a first offense.

APD Make 37 DWI Arrests Over ROT Rally Weekend

The Austin Police Department held another “No Refusal” weekend on Friday and Saturday nights, meaning officers can request a warrant to draw blood by force if a driver refuses a breathalyzer. It was the first time during the Republic of Texas motorcycle rally that APD implemented the policy. Last year, there were three alcohol-related fatal motorcycle accidents during the ROT Rally.

There were a total of 37 DWI's over the No refusal weekend.
